​General Terms and Conditions (GTC) of

Hills Car Rental La Nucia, Alicante

​

1. Scope of application

These General Terms and Conditions (GTC) apply to all contractual relationships between Hills Car Rental (hereinafter referred to as "Lessor") and the renter arising from the rental of vehicles. Deviating agreements must be confirmed in writing by the lessor.

2. Conclusion of the contract and rental object

2.1. The rental contract is concluded as soon as the renter takes delivery of the vehicle made available by the lessor and acknowledges the contract conditions by signing.

2.2. The rental object refers exclusively to the vehicle specified in the rental contract, including accessories and equipment, as specified in the handover protocol.

2.3. Required Documents for Drafting the Rental Contract
To draft the car rental agreement, it is mandatory to provide a copy of a valid driver’s license (front and back) and an ID card or passport of the driver. These documents are required to verify the identity of the renter and comply with legal requirements.
Please ensure that the documents are clearly legible and within their validity period.

3. Rental period and return

3.1. The rental period is determined by the dates specified in the rental contract.

3.2. The renter undertakes to return the vehicle in perfect condition at the agreed time and place.

3.3. An extension of the rental period requires the consent of the lessor.

3.4. In the event of late return, the renter must pay an additional day's rent, as well as any costs for the loss of use of the vehicle by the lessor.

4. Rental price and payment conditions

4.1. The rental price is based on the rates applicable at the time the contract is concluded and is recorded in the rental agreement.

4.2. All prices include statutory VAT, unless expressly agreed otherwise.

4.3. The rental price must be paid in advance or according to the payment conditions set out in the contract.

5. Obligations of the renter

5.1. The renter undertakes to handle the vehicle with care and to comply with all applicable traffic regulations.

5.2. The renter may not sublet the vehicle or make it available to third parties.

5.3. The renter is liable for all damage caused by improper use of the vehicle.

5.4. The renter must return the vehicle in the same condition as when it was received, except for normal wear and tear.

5.5. Usage requirements and age requirements:

  • The renter must use the vehicle under the following conditions: The vehicle may not be used to push or pull another vehicle or trailer.

  • No modifications may be made to the vehicle, such as mounting roof racks, luggage or goods on the roof.

  • The vehicle may not be used for sporting events, training of any kind or for testing vehicle parts, accessories or products.

  • The vehicle and any associated parts or tools may not be transferred, sold, sublet, pledged or loaned.

  • The vehicle may not be driven under the influence of alcohol or drugs. If the driver is under the influence of alcohol or drugs and causes an accident, the renter is fully liable for all damages to all parties involved.

  • The vehicle must not leave Spain.

  • The odometer must not be tampered with or sealed. The renter must report any damage to the odometer. The number of kilometers is measured with the odometer or with the help of cards if the odometer is defective.

  • Each vehicle is equipped with a tracking system.

  • The renter must stop and immobilize the vehicle if a malfunction occurs or a warning light indicates a malfunction, and must contact the lessor immediately.

  • The rented vehicle must not be used to transport passengers or goods for commercial or industrial purposes, unless this is the purpose of the rental contract.

  • Commercial vehicles must not be used to transport goods that are classified as special, in accordance with the applicable transport regulations.

  • Smoking is prohibited in the vehicle, including the use of e-cigarettes, vapes or other forms of smoking. It is also prohibited to drink alcohol in the vehicle.

  • The vehicle may only be driven by the renter and their specified co-driver. The renter must be at least 25 years old at the start of the rental period and have held a valid driver's license for at least 2 years.

  • Speed cameras and traffic violations: The renter is responsible for all traffic violations associated with the vehicle, including fines or penalties resulting from the use of the vehicle in speeding violations or other traffic offenses, such as speed cameras. All incurred fees, fines, or penalties will be charged to the renter, who agrees to pay them promptly. Additionally, an administrative fee of 25 euros will be charged once a speed camera or other traffic violations are reported to us. The renter must settle these fees and penalties.

6. Insurance and liability

6.1. Comprehensive All-Risk Insurance

  • The comprehensive all-risk insurance covers damages to the rental vehicle resulting from an accident or an unforeseen event, provided that the driver was not under the influence of alcohol, drugs, or other substances prohibited by law at the time of the incident.

  • Coverage applies only if the contractual and legal provisions, particularly traffic regulations, are adhered to. The renter is obliged to report any damages immediately and truthfully document the circumstances of the incident.

  • In the event of proven violations of the aforementioned conditions, the insurance coverage becomes void, and the renter will be fully liable for the damages incurred.

  • Damages caused intentionally, through gross negligence, by unauthorized drivers, or uses outside the agreed rental purpose are not covered.

6.2. Accidents and theft: In the event of an accident, the renter must immediately inform the lessor of all incidents.

and fill out an accident report with all details of the other party and any witnesses. Photographs as evidence must also be taken and sent to the lessor immediately.

6.3. The competent authorities must be informed if a party is injured. The renter must not leave the rented vehicle, as far as possible, without taking the necessary precautions for his own safety.

6.4. In the event of theft, the renter must report it to the police and send a copy to the lessor. The renter can contact the lessor by telephone or e-mail.

6.5. Liability for Theft: The rental company is not liable for loss, theft, or damage to personal belongings in the rented vehicle during the rental period.​

7. Fuel and operating costs

7.1. The renter receives the vehicle with a full tank and is obliged to return it with a full tank.

7.2. All operating costs during the rental period, such as fuelor tolls, are the responsibility of the renter.

8. Termination

8.1. The cancellation of a car rental agreement is only possible up to at least three days before the agreed rental date. If the cancellation occurs later, Hills Car Rental reserves the right to retain the full amount. Cancellation must be done via email to be effective.

9. Limitation of liability of the lessor

The lessor is only liable for damage caused intentionally or through gross negligence. Liability for consequential damage or loss of profit is excluded.

10. Data protection

The lessor undertakes to treat the renter's personal data in accordance with the applicable data protection legislation and to use it exclusively for the execution of the rental agreement.

11. Jurisdiction and applicable law

11.1. The competent court in Alicante, Spain, has jurisdiction for all disputes arising from or in connection with the rental agreement.

11.2. Spanish law shall apply.

12. Severability clause

If any provision of these General Conditions is invalid, the validity of the remaining provisions shall remain unaffected. The parties undertake to replace the invalid provision with a valid provision that comes as close as possible to the economic purpose of the invalid provision.
